These Terms & Conditions ("Terms") govern your access to and use of the OMR Checker website and application (the "Service") provided by OMR Checker, operated from Samastipur, Bihar, India. By creating an account or using the Service you agree to these Terms.
1. Account Registration
- You must provide accurate and current information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must be authorised to represent the coaching institute or school associated with the account.
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful activity.
- Attempt to reverse-engineer, resell, or clone the Service.
- Upload malware, run automated attacks, or otherwise disrupt the Service.
- Use the Service to store or process data you do not have the right to use.
- Share your account credentials with unauthorised third parties.
3. Student, Exam and Result Data
You are solely responsible for the accuracy of student information, exam configurations, answer keys, and OMR sheets that you upload or generate inside the Service. OMR Checker acts as a tool that processes the data you provide. You are responsible for verifying that generated results are accurate before publishing them.
4. OMR Processing Limitations
OMR Checker uses computer-vision techniques to read filled bubbles on scanned answer sheets. Recognition quality depends on the physical condition of the sheet (print quality, filling darkness, folds, stains, glare, etc.). While we work hard to maximise accuracy, we do not warrant a specific recognition rate for every sheet. You should always review results before releasing them.
5. Subscription Plans and Billing
- The Service is offered on a subscription basis with Monthly and Yearly plans (and any other plans we may introduce).
- Plan prices, features and validity periods are displayed inside the app on the Billing / Subscription page.
- By subscribing, you authorise the applicable charge for the selected plan and its stated validity period.
- Subscription renewals, cancellations and refunds are governed by our Refund & Cancellation Policy.
6. Free Trial
Where offered, a free trial gives you time-limited access to the Service so you can evaluate it. No payment is required during the trial. Once the trial ends, continued access requires an active paid subscription.
7. Service Availability
We strive to keep OMR Checker available at all times, but the Service is provided on an "as-is" and "as-available" basis. We may need to perform maintenance, roll out updates, or take components offline temporarily. We are not liable for downtime, delays, or interruptions.
8. Intellectual Property
The OMR Checker name, logo, application code, design, and underlying technology are the property of the OMR Checker team. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
9. Your Content
You retain ownership of the student records, exam data, answer keys, and results you create in the Service. You grant us a limited right to process this content solely to provide the Service to you.
10. Suspension and Termination
We may suspend or terminate your access to the Service if:
- You breach these Terms or our acceptable-use rules.
- Your subscription payment fails or your plan expires without renewal.
- We are required to do so by law.
You may stop using the Service at any time by discontinuing use and, if applicable, cancelling your subscription.
11. Limitation of Liability
To the maximum extent permitted by law, OMR Checker and its team shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, or goodwill arising out of your use of, or inability to use, the Service. In no event will our total liability exceed the amount you paid us for the Service in the twelve months preceding the claim.
12. Changes to the Service or Terms
We may modify, add or remove features of the Service at any time. We may also update these Terms from time to time; the updated version will be posted on this page with a new "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of India. Any disputes arising in relation to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Bihar, India.
